1. General
1.1 These Terms and Conditions (“Terms”) contain all of the terms upon which you engage Safecoat Epoxy Flooring Pty Ltd (“Safecoat,” “we,” “us”) to provide goods and services to you and will be deemed incorporated into any order made by you.
1.2 In these Terms, unless the context or subject matter otherwise requires:
- Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth) and related legislation and regulations.
- GST has the same meaning as in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
- Quotes and quotation means any written Quote provided by Safecoat for the provision of goods and services under these Terms.
- Services means all goods and services provided to you by Safecoat for the provision of payment from time to time.
- Us, our, or we refers to Safecoat.
- You or your refers to you as the individual, company, entity, trust, or business engaging Safecoat to provide Services to you.
2. Quotes for Services
2.1 Written quotations are valid for thirty (30) days from the date issued unless otherwise specified. Prices may vary if work is not commenced within this period or if changes to the scope of work are requested.
2.2 All prices quoted are inclusive of labour costs, insurances, and administration costs. Quotes do not include staging costs unless explicitly stated.
2.3 Quotes are provided on the assumption that the concrete, the subject of the works, is sound, dry, and fully cured. It is your responsibility to notify us of any issues with the concrete.
2.4 Acceptance of our Quote may be confirmed through written correspondence, verbal communication, or a purchase order (if required). Such acceptance forms a binding contract that incorporates these Terms.
2.5 Any variations to the agreed Quote must be communicated in writing and may result in additional charges or revised timeframes. Safecoat reserves the right to accept or reject such variations.
2.6 The price in the Quote is subject to change if unforeseen issues arise during the provision of Services.
2.7 All works will be completed in compliance with Australian laws and standards and are subject to a final site inspection.
3. Payment Terms
3.1 Deposits of 30% are required to confirm your booking, unless otherwise agreed.
3.2 Payments can be made via bank transfer or other specified methods outlined in your invoice.
3.3 Progress payments may be required for projects exceeding $5,000. Final payment is due upon completion unless otherwise agreed.
3.4 Overdue payments will attract a late fee of 2% per month, and we reserve the right to suspend or cease work if payments are not made on time.
4. Cancellations and Refunds
4.1 Cancellations made within 7 days of the scheduled start date may result in forfeiture of your deposit.
4.2 Refunds for deposits will only be issued if Safecoat cannot complete the project due to factors within our control.
4.3 Rescheduling installation dates will be subject to availability, and Safecoat will not be liable for delays caused by such requests.
5. Site Access and Preparation
5.1 You are responsible for providing clear and safe access to the worksite, including adequate lighting, access to amenities, and a clean and debris-free workspace. Additional charges may apply if our team must clean or clear the site.
5.2 Access to water and electricity is required for the duration of the project. Delays caused by lack of access may result in additional charges.
6. Workmanship and Materials
6.1 Safecoat guarantees all workmanship for a period of 12 months from the date of completion. This warranty covers defects resulting from our work but excludes normal wear and tear, misuse, or external factors.
6.2 Any warranties on materials are provided by the manufacturers.
7. Liability and Indemnity
7.1 Safecoat’s liability is limited to the cost of the Services provided. We are not liable for indirect or consequential losses, including loss of income, profit, or business.
7.2 You indemnify Safecoat against any claims, damages, or liabilities arising from your breach of these Terms.
8. Dispute Resolution
8.1 In the event of a dispute, both parties agree to first attempt resolution through good faith negotiations. If unresolved, the matter will be referred to mediation before pursuing legal remedies.
9. Force Majeure
Safecoat is not liable for delays or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, or government actions.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of Victorian courts.
11. Amendments
Safecoat reserves the right to update these Terms and Conditions at any time. Updated terms will be published on our website and will apply to future projects
